Rubbish Collection Hammersmith Terms and Conditions of Service
These Terms and Conditions set out the basis on which Rubbish Collection Hammersmith provides waste collection and related services. By booking or using our rubbish removal or waste collection services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions shall have the meanings set out below:
1.1 Service means any rubbish collection, household waste removal, commercial waste removal, bulky item collection, recycling service, loading, transportation or disposal service provided by us.
1.2 We, us or our means the operator of Rubbish Collection Hammersmith providing the Service.
1.3 You or your means the customer placing a booking or using the Service, whether as an individual, business, landlord, tenant, managing agent or any other entity.
1.4 Booking means a confirmed request for our Service, whether placed online, by telephone, by email or in writing, and accepted by us.
1.5 Waste means any rubbish, refuse, junk, debris, garden waste, furniture, appliances or other items you ask us to remove as part of the Service, excluding prohibited items listed in these Terms and Conditions.
1.6 Premises means the address or location where the Waste is to be collected and where the Service is to be carried out.
2. Scope of the Service
2.1 We provide rubbish collection and waste removal services for domestic and commercial customers, including the loading, carrying, transportation and disposal or recycling of Waste in accordance with applicable waste regulations in the United Kingdom.
2.2 Our Service is provided within our stated service area, which includes Hammersmith and surrounding districts, subject to our operational capacity and route planning. We reserve the right to decline or cancel bookings that fall outside our service area or that we reasonably determine cannot be serviced efficiently or safely.
2.3 We will not handle or remove any items that are hazardous, toxic, explosive, corrosive, flammable, medical, clinical or otherwise classified as dangerous or special waste under relevant UK legislation, including but not limited to asbestos, chemicals, solvents, paint, oils, fuel, gas cylinders, syringes and biological waste, unless expressly agreed in writing in advance and subject to additional charges and specialist handling arrangements.
3. Booking Process
3.1 You may request a quotation or make a booking by telephone, email or through our online booking system where available. Any quotation provided before we see the Waste is an estimate only and may be adjusted once our team inspects the load on arrival at the Premises.
3.2 When making a booking you must provide accurate information, including but not limited to the type and approximate volume or weight of Waste, the location and access details of the Premises, any parking restrictions, and any other relevant information that may affect the performance of the Service.
3.3 Your booking is only confirmed when we issue a booking confirmation by email, text message or verbally over the phone, specifying the date, approximate time window, and indicative price or pricing basis.
3.4 All bookings are subject to availability. Time windows are approximate and not guaranteed, but we will use reasonable endeavours to attend within the agreed period. We reserve the right to reschedule a booking where necessary due to operational or safety reasons, severe weather, traffic disruption, vehicle breakdown or staff illness, and we will notify you as soon as reasonably practicable.
3.5 You must ensure that an authorised person is present at the Premises at the time of collection to grant access, confirm the Waste to be removed and approve any changes to the quoted price where applicable. If no one is present, we may, at our discretion, attempt to contact you to obtain instructions, or treat the booking as a failed attendance subject to our cancellation and waiting time charges.
4. Access and Parking
4.1 You are responsible for ensuring that our team has safe and reasonable access to the Premises, including suitable parking for our vehicle near the collection point, clear pathways and safe conditions for loading the Waste.
4.2 Any parking fees or permits required for our vehicle to attend the Premises must be arranged and paid by you in advance or reimbursed to us on the day of Service. If no legal parking is available or parking restrictions prevent us from reasonably performing the Service, we may treat the job as a failed attendance and charge a call-out or cancellation fee.
4.3 We reserve the right to refuse to carry out any part of the Service if our team reasonably considers that access is unsafe, that there is risk of injury, damage to property or vehicle, or that the Premises are not adequately prepared for the collection. In such cases, you may still be liable for a call-out or attendance fee.
5. Pricing and Payments
5.1 Our charges are generally based on the volume and type of Waste collected, the labour time required, any additional services requested and any disposal, recycling or regulatory charges incurred. Prices may vary depending on load size, access conditions, distance from vehicle to Waste, and any special handling requirements.
5.2 Unless we have provided a fixed-price quotation in writing, any price given in advance is an estimate only. The final price will be confirmed on site once our team has inspected the Waste before loading. If you do not agree to the revised price, you may decline the Service, in which case we may charge a call-out fee to cover our time and costs.
5.3 Payment is due in full on completion of the Service, unless otherwise agreed in writing in advance. We accept payment by cash, debit or credit card, or bank transfer where arranged beforehand. For commercial account customers, separate payment terms may apply.
5.4 Where payment is not received on completion, we reserve the right to withhold removal of the Waste, or, if the Waste has already been removed, to pursue recovery of the outstanding sum, including any reasonable legal or collection costs incurred.
5.5 All prices are quoted inclusive or exclusive of VAT as stated at the time of booking. If VAT is applicable, it will be charged at the prevailing rate.
6. Cancellations, Amendments and Waiting Time
6.1 You may cancel or amend your booking by giving us at least 24 hours notice before the scheduled arrival time. Where you provide less than 24 hours notice, we reserve the right to charge a cancellation fee to cover our allocated time and costs.
6.2 If you are not present at the Premises at the agreed time, if access is not available, or if the Waste is not ready for collection, we may apply a waiting charge or treat the booking as a failed attendance and charge a call-out fee. Any decision to reschedule without charge will be at our discretion.
6.3 We may cancel or reschedule a booking at any time for reasons including but not limited to safety concerns, vehicle issues, staff shortages, extreme weather, regulatory requirements or circumstances beyond our reasonable control. Where we cancel, our liability will be limited to rebooking the Service at a mutually convenient time or refunding any amount you have already paid for the affected booking.
7. Customer Responsibilities
7.1 You must ensure that the Waste you present for collection corresponds to the description provided at the time of booking and does not include any prohibited items or hazardous waste. If our team discovers such items, we may refuse to remove them, adjust the price, or decline the job in full.
7.2 You are responsible for separating any items that you do not wish us to take. Our team may remove all items reasonably believed to be Waste as part of the Service, and we cannot be held liable for the removal of items that were not clearly identified as items to be kept.
7.3 You must ensure that any confidential or sensitive information has been removed from items given to us for disposal. We do not provide a document destruction service unless specifically arranged in advance.
8. Waste Handling and Environmental Compliance
8.1 We operate in accordance with relevant UK waste management legislation and guidelines. We are committed to responsible rubbish collection, seeking to divert as much material as reasonably practicable from landfill through reuse and recycling, subject to the nature and condition of the Waste.
8.2 By using our Service, you authorise us to collect, transport, store, process and dispose of the Waste on your behalf in accordance with applicable waste regulations. Title to the Waste transfers to us at the point of loading onto our vehicle, subject to compliance with these Terms and Conditions and applicable law.
8.3 We may use licensed waste transfer stations, recycling centres and disposal facilities, and we may work with third-party partners for processing, reuse or recycling of materials. We do not guarantee that any particular item will be recycled or reused, but we will make reasonable efforts in line with our environmental commitments and operational capabilities.
9. Liability and Limitations
9.1 We will exercise reasonable skill and care in the provision of the Service. However, to the fullest extent permitted by law, we shall not be liable for any indirect, consequential or economic loss, including loss of profits, loss of business, loss of opportunity or loss of data arising from or in connection with the Service.
9.2 Our total aggregate liability for any loss or damage arising out of or in connection with a particular booking, whether in contract, tort including negligence, breach of statutory duty or otherwise, shall be limited to the total price paid or payable by you for that booking.
9.3 We shall not be liable for any damage to driveways, paths, access routes, underground services or property where our vehicle is required to leave the public highway at your request, or where the surface or access is unsuitable for heavy vehicles.
9.4 You must notify us in writing of any claim for loss or damage as soon as reasonably practicable and in any event within seven days of the date on which the Service was provided. We may require evidence, photographs or access to inspect any alleged damage before accepting or rejecting a claim.
9.5 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which liability cannot lawfully be limited or excluded under UK law.
10. Insurance
10.1 We maintain appropriate public liability insurance in connection with the provision of our rubbish collection and waste removal services.
10.2 Our insurance does not relieve you of your responsibility to take reasonable steps to protect your property, including removing fragile or valuable items from areas where our team will be working and ensuring safe access routes.
11. Data Protection and Privacy
11.1 We collect and process personal data such as your name, contact details and service address for the purpose of managing bookings, providing the Service, processing payments and handling customer queries.
11.2 We will handle your personal data in accordance with applicable data protection laws in the United Kingdom. We will not sell your personal data to third parties. We may share limited information with our staff, contractors or service partners where necessary to deliver the Service or comply with legal obligations.
12. Complaints and Dispute Resolution
12.1 If you are dissatisfied with any aspect of our Service, you should contact us as soon as possible, providing full details of your concern, the date of Service and any supporting information.
12.2 We will investigate your complaint and aim to respond within a reasonable timeframe. Where appropriate, we may offer to rectify the issue, provide a partial refund or take other remedial action at our discretion.
12.3 If a dispute cannot be resolved informally, either party may consider alternative dispute resolution methods such as mediation. This does not affect your statutory rights to bring a claim before the courts.
13. Amendments to these Terms and Conditions
13.1 We may update or amend these Terms and Conditions from time to time to reflect changes in our services, pricing, operational practices, legal requirements or regulatory guidance.
13.2 The version of the Terms and Conditions that applies to your booking will be the version in force at the time you make the booking. Continued use of our rubbish collection services after changes have been published shall constitute your acceptance of the updated Terms and Conditions.
14. Governing Law and Jurisdiction
14.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.
14.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service, including any non-contractual disputes or claims, save that if you are a consumer resident in another part of the United Kingdom, you may have the right to bring proceedings in your local courts.
15. General Provisions
15.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be severed from the remaining provisions, which shall continue in full force and effect.
15.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.
15.3 You may not assign or transfer your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or transfer our rights and obligations to another organisation as part of a business transfer or restructuring, provided that this does not materially affect your rights under these Terms and Conditions.
15.4 These Terms and Conditions constitute the entire agreement between you and us in relation to the provision of our rubbish collection and waste removal services and supersede any prior understandings, representations or agreements, whether oral or written.
